1. CONDITIONS OF ENGAGEMENT
Coastal Draughting Ltd will exercise all reasonable skill care and diligence in the performance of its duties under the contract as would be expected of a competent drawing office.
2. FEES
Fees are by negotiation. Unless agreed otherwise before the commission is carried out, the fees will be based on time charges.
Once appointed, Coastal Draughting reserve the right, should the contract be cancelled, postponed or in anyway delayed, to submit a fee account to the Client for the work completed to date.
3. SPECIALIST CONSULTANTS
Where specialist consultants are employed and are not commissioned by the client direct, a charge of 10% will be added to their account to cover professional indemnity insurance and administration.
4. EXPENSES
Unless otherwise agreed, out of pocket expenses are charged in addition to fees at the following rates: -
Photocopying per sheet £0.10 (A4), £0.25 (A3)
Printing per drawing £1.50
Travel by car per mile £0.75
by train At cost (directors first class)
Others such as subsistence, courier, maps, photographs, etc. At cost + 10%
5. SETTLEMENT
Fees will be invoiced monthly or at suitable stages of the commission as detailed in the original fee proposal. Settlement is due at the date of the invoice. Invoices not settled within Thirty days of the date of the invoice will attract interest at the rate of 2.0% per month from the date of the invoice. Coastal Draughting reserve the right either to suspend work on a project, or to terminate the engagement, in their absolute discretion if fees are not settled before the final date for payment, i.e. 30 days after the date of invoice. Such right will not be exercised without first giving at least seven days' notice of intention to suspend performance/terminate the engagement.
6. VALIDITY
The rates for time charges and expenses set out above are valid until 01st January 2021.
7. LIMIT OF LIABILITY
Coastal Draughting shall not be liable for any loss (including consequential losses), costs, damages, charges or expenses in respect of calculations, site dimensions, section sizes, fabrication drawings and general arrangements included in its services, whether they have been supplied to us or not. Coastal Draughting’s liability in contract shall be limited to 10% of the price paid for its services.
8. PROFESSIONAL INDEMNITY INSURANCES
The level of professional indemnity insurance to be carried by Coastal Draughting for any one occurrence or series of occurrences is £100,000. The period for which the Professional Indemnity Insurance is to be maintained is from the effective date of the appointment to six years after the date of substantial/practical completion of the project provided always that such insurance is available at commercially reasonable rates.
9. THIRD PARTY RIGHTS
Nothing in this agreement confers or purports to confer on any third party any benefit or any right to enforce any term of this Agreement.
10. MATERIALS
Coastal Draughting will not, unless authorised in writing by the Client, specify for use any materials that by their nature or application contravene any current British Standard or which at the time of specification are generally known to our profession to be deleterious.
